Justice Martin Burns said Scown was not responsible for the injuries that killed Tyrell but failed in his duty of care.
The boy had 53 bruises and 17 abrasions from head to legs when he died, the court heard.
"You ought to have acted yourself, regardless of her wishes".
"Clearly you were very anxious about the little boy", he said.
The judge said Tyrell Cobb "would have survived if he received treatment".
However there's been universal outrage over the case, with children's safety advocates calling for him to be put behind bars.
