Ryan Boylan, 40, of Clearwater, says he needs Brutis to deal with anxiety from a long ago vehicle accident but Island Walk Condominiums says the squirrel needs to vacate the premises because she is putting other residents at risk.
Boylan said he found the squirrel trapped under someone's auto.
Property management at Island Walk Condominiums discovered Brutis back in April when she was chased up a tree by a dog. Boylan's doctor, meanwhile, wrote him a prescription for an emotional support animal in July after a vehicle crash left him with several herniated disks in his lower back and PTSD.
But according to a complaint filed by the condo association, Boylan never notified the property managers in writing that Brutis was an emotional support animal until the summer.
The doctor's note shows further proof that the Florida man has the right to have an emotional support animal.
His doctor said Boylan suffers from post-traumatic stress disorder following a vehicle accident.
A letter from his doctor stated: 'I have prescribed Ryan to obtain emotional support animal (s). Boylan has a doctor's note saying that he is suffering from PTSD after a auto accident, but the condo board pointed out that Boylan only registered Brutis on RegisterMyServiceAnimal.com as an emotional support animal this summer. "The presence of the animal (s) is necessary for the emotional/mental health of Ryan Boylan".
